Distance Sales Contract

Parties
SELLER / SERVICE PROVIDER: the party whose identity and contact details are written in the company details.
BUYER: the person who purchases a subscription or coins through the LumaReef app. The Buyer declares that they have read and accepted the preliminary information form presented to them during the purchase and this contract.
Subject of the contract
This contract governs the sale of the digital content and services that the Buyer purchases electronically inside the LumaReef app, together with the rights and obligations of the parties.
The contract is subject to the provisions of Turkish Consumer Protection Law No. 6502 and the Turkish Distance Contracts Regulation.
Products and services covered by the contract
Two kinds of product are offered for sale and both are digital content; there is no physical delivery.
- Subscription: a service that gives access to the paid features of LumaReef for a set period and renews by itself at the end of that period unless the Buyer cancels.
- Coins: a virtual unit purchased once and used to unlock species and content inside the app. A coin is not money, cannot be converted into cash and cannot be used outside the app.
Price and payment
The sale price of the products, taxes included, is shown at the moment of purchase on the store screen inside the app and in the currency of the Buyer’s store account. The price shown is the price valid at that moment.
Payment is collected by the relevant store through the payment method registered to the Buyer’s App Store or Google Play account. The Seller has no access to the Buyer’s card details, bank details or billing address.
For a subscription, the price is collected with the same payment method at the beginning of each renewal period. In the event of a price change, the notification rules of the store apply and the Buyer has the opportunity to cancel before the renewal.
Performance and delivery
The digital content covered by the contract is added to the Buyer’s account immediately after the payment is approved by the store. There is no separate delivery period and no delivery cost.
The technical conditions required for performance: a current iOS or Android device, the LumaReef app installed, and an internet connection. Displaying on a screen additionally requires a television app or a screen with a browser.
Right of withdrawal
Under Article 15/1(ğ) of the Turkish Distance Contracts Regulation, the right of withdrawal cannot be exercised in contracts for services performed instantly in the electronic environment and for intangible goods delivered instantly to the consumer.
Subscription and coin purchases inside LumaReef fall within this scope: the content is added to the account the moment the payment is approved and performance begins. By confirming the purchase, the Buyer accepts that they have expressly consented to performance beginning immediately and that with this consent they lose the right of withdrawal.
This clause does not remove the optional rights of the Buyer arising from Law No. 6502 where the product is defective. In the case of a defective service, the Buyer may exercise the rights arising from the law, including a refund of the price.
Subscription term, renewal and cancellation
The subscription renews by itself for the chosen period length unless the Buyer cancels.
Cancellation is made at least twenty-four hours before the renewal date, from the subscription settings of the store where the purchase was made. A cancelled subscription keeps working until the end of the period that has been paid for.

Declarations of the Buyer
The Buyer accepts that, before the purchase, they were informed about the essential qualities of the product covered by the contract, its price including taxes, the payment method, the manner of performance and the absence of a right of withdrawal.
The Buyer accepts that, if under eighteen, they may make the purchase only with the permission of their parent or guardian.
When the contract is formed
The contract is formed when the Buyer confirms the transaction on the purchase screen inside the app and the payment is accepted by the store.
As of the last update date of this document, LumaReef is not yet live in the app stores; this contract applies to purchases made after it goes live.
Resolution of disputes
The Buyer may bring complaints and objections to the Consumer Arbitration Committee or the Consumer Court of their place of residence or of the place where the transaction was made, within the monetary limits set each year by the Ministry of Trade.
The Buyer may also use the refund and support channels of the app store where the purchase was made. Using those channels does not prevent the Buyer from exercising the rights arising from the law.
Entry into force
When the Buyer confirms the purchase, they are deemed to have accepted all the conditions of this contract and the contract enters into force at that moment.
